ABSTRAK

Mediasi merupakan salah satu tahapan dalam proses persidangan. Mediasi wajib ditempuh oleh para pihak, yang bersengketa dalam perkara perdata di semua lingkungan peradilan. Mediasi merupakan suatu hukum, sebagaimana Negara Indonesia adalah negara hukum. Pasal 1 Undang-Undang Dasar Tahun 1945 merupakan suatu konstitusi yang mengatur bentuk negara Indonesia sebagai negara hukum. Kontribusi mediasi berbasis luring dan daring terhadap penyelesaian perkara di pengadilan wilayah Pengadilan Tinggi Agama Mataram apabila digabungkan, keduanya nampaknya tidak terlalu signifikan dalam menyelesaikan perkara, baik mediasi dalam luring maupun daring.Rendahnya tingkat keberhasilan disebabkan karena faktor mediator dan faktor para pencari keadilan. Faktor mediator dinilai karena kurangnya kemampuan kemampuan (skill) mediator, mediator hanya melaksanakan mediasi sesuai asas legal formal, mediator kurang menguasai ilmu peran, ilmu komunikasi, ilmu psikologi keluarga yang mengakibatkan kekakuan dalam melaksanakan mediasi, bila mediator memiliki multi disiplin ilmu, tentunya akan menelurkan hasil pelaksanaan mediasi yang lebih baik. Faktor pencari keadilan dinilai karena kurang seriusnya dalam mengikuti forum mediasi yang dipimpin oleh mediator dan masing masing sudah berpegang teguh pada prinsipnya
